Abstract
The increasing progress of the aviation industry, especially in the
civil sector, and the access of the owners of this industry to the technology
of transporting goods and passengers on a large scale and the many advantages
of using this technology, have caused the worldwide popularity of this
industry. The Chicago Convention, the International Civil Aviation Organization
(ICAO), and the International Air Transport Association (IATA) play a role in
this and have a great contribution to systematizing international commercial
air activities. During the conclusion of the air transport contract, the
governments, with their agreement and will, also determine the dispute
resolution authorities arising from these relations, and often such disputes
are resolved outside the framework of ICAO; Due to the impossibility of dealing
with disputes related to bilateral commercial air services in the ICAO dispute
settlement system, new proposals have been made to form an international
dispute settlement body to deal with disputes and to create unity in the field
of interpretation of bilateral contracts. In resolving commercial disputes,
they have international airlines.
