Mitigating cyber security risks through the principle of subrogation in cyber insurance in Indonesia

Abstract
The absence of adequate legal regulations regarding Cyber Security
Risks through the application of the subrogation principle in the Cyber
Insurance industry can create legal uncertainty in protecting against threats
to cyber security in the cyber insurance industry. This research aims to
explore the role of the state in mitigating Cyber Security Risks in the Cyber
Insurance Industry. The method used is normative legal analysis to assess the
extent of the state's role in establishing rules to provide legal protection
and legal certainty in the cyber insurance industry. The research results
indicate that existing legal regulations have not been able to provide adequate
legal protection, which may disrupt or hinder the growth of the cyber insurance
industry. It is important to establish legislation that can provide legal
protection for the sustainability of the cyber insurance industry, particularly
in the application of the subrogation principle.
