Legal and institutional framework for the protection of persons living with HIV and AIDS in Nigeria: Issues

Abstract
HIV infection and AIDS in Nigeria remain a major public health crisis
and are one of the most common causes of death in Nigeria with about 250,000
infections occurring annually. In an environment that is filled with sigma and
discriminatory attitudes and practices against persons living with HIV and
AIDS, such persons will likely have difficulty accessing information,
counselling, and support services that would prolong their lives. They may also
be reluctant to disclose their status to seek assistance for fear of
repercussions. The need to protect and promote the rights of persons living
with HIV/AIDS is therefore imperative. This work examined the legal and
institutional framework for the protection of persons living with HIV and AIDS
in Nigeria with a focus on the 1999 Constitution of the Federal Republic of
Nigeria (as amended), The HIV/AIDS Anti-Discrimination ACT 2014 and the Rules
of Professional Conduct for Medical and Dental Practitioners 2008. The work
also highlighted the role of governmental and non-governmental institutions
like the Federal Ministry of Health, the National Human Rights Commission and
the National Agency for the Control of AIDS (NACA) in ensuring the protection
of Persons living with HIV and AIDS. The work concluded with some
recommendations which the researcher believes will enhance the disposition or
attitude of members of society towards persons living with HIV and AIDS in
Nigeria.
