Strengthening India’s legal framework and policy strategies for sustainable seabed mining: Challenges and opportunities

Abstract
Seabed mining has emerged as a critical area
of interest for India due to its vast maritime resources and the growing global
demand for minerals essential for technology and economic progress. With
India’s strategic location along the Indian Ocean, the country holds
significant potential to harness seabed resources like rare earth elements and
polymetallic nodules. However, this potential is tempered by significant
environmental challenges, regulatory gaps, and geopolitical considerations.
This paper examines India’s current legal framework for seabed mining,
identifying deficiencies in regulations and their enforcement, and highlights
the urgent need for a robust governance system. It also explores the
environmental implications of seabed mining, emphasizing the importance of
sustainable practices and international collaboration. Through a critical
analysis of existing policies and global best practices, the study recommends a
balanced approach that aligns economic growth with ecological preservation. The
findings underscore the necessity of inclusive policymaking, stakeholder
engagement, and adaptive legal strategies to ensure the sustainable
exploitation of seabed resources while safeguarding marine ecosystems.
