Abstract
Corporate criminal liability in India refers to the legal concept that holds corporations or corporate entities accountable for criminal offenses committed under their name, either by their employees, agents, or other individuals associated with them. Traditionally, criminal liability was attributed only to individuals, but as businesses play an increasingly significant role in society, there is a growing recognition of the need to hold corporations responsible for their actions that may cause harm, fraud, or other criminal activities. The introduction of corporate criminal liability addresses the limitations of focusing solely on individual wrongdoers, especially in cases where the actions were carried out as a result of corporate culture, policies, or decisions. This concept aims to ensure that corporations are not immune to prosecution and penalties when their actions result in criminal consequences. It also acts as a deterrent against corporate misconduct, encouraging companies to adopt ethical practices and maintain compliance with the law.
