Legal politics of cybersecurity governance in Indonesia: Strengthening national cyber resilience in the digital era

Abstract
The rapid advancement of information and communication technology has
significantly increased Indonesia’s dependence on digital infrastructure across
government, business, and public services. While digital transformation has
improved efficiency and economic growth, it has also heightened the risk of
cyber threats, including cyberattacks, data breaches, ransomware, and cyber
espionage. These developments require a comprehensive legal framework capable
of ensuring cybersecurity while protecting national interests and citizens'
digital rights. This article examines the legal politics of cybersecurity
governance in Indonesia by analyzing the legal policy underlying cybersecurity
regulation, the state's role in developing national cyber resilience, and the
challenges encountered in implementing cybersecurity governance. This study
employs a normative juridical approach using statutory, conceptual, and
literature-based analyses. The findings indicate that Indonesia’s cybersecurity
legal policy reflects the state's commitment to strengthening national security
and supporting digital transformation through various laws, regulations, and
institutional arrangements. Nevertheless, the effectiveness of cybersecurity
governance remains constrained by regulatory fragmentation, institutional
overlap, limited human resource capacity, and the increasing sophistication of
cyber threats. Therefore, strengthening legal harmonization, institutional
coordination, and cybersecurity awareness is essential to establish an adaptive
and resilient national cybersecurity system.
